The deliberate intent to commit an injury, as evidenced by external circumstances.<\/strong> \u2014 aka<span style=\"color: #800000;\"><em><strong> express malice<\/strong><\/em><\/span>; <span style=\"color: #800000;\"><em><strong>malice in fact<\/strong><\/em><\/span>.<br \/>\n<\/span><\/p>\n<p><span style=\"font-size: 14pt; color: #000000;\">2. <em>Defamation<\/em>. <strong>Knowledge (by the person who utters or publishes a defamatory statement) that a statement is false, or reckless disregard about whether the statement is true.\u00a0 *\u00a0 To recover for defamation, a plaintiff who is a public official or public figure must overcome the defendant\u2019s qualified privilege by proving the defendant&#8217;s actual malice.\u00a0 And for certain other types of claims, a plaintiff must prove actual malice to recover presumed or punitive damages. <\/strong>\u2014 aka <span style=\"color: #800000;\"><em><strong>New York Times malice<\/strong><\/em><\/span>; <span style=\"color: #800000;\"><em><strong>constitutional malice<\/strong><\/em><\/span>;<span style=\"color: #800000;\"> <em><strong>common-law malice<\/strong><\/em><\/span>.
