1. The requisite mental state for common-law murder, encompassing any one of the following:<\/strong><\/span><\/p>\n

(1) the intent to kill,
\n(2) the intent to inflict grievous bodily harm,
\n(3) extremely reckless indifference to the value of human life (the so-called \u201cabandoned and malignant heart\u201d), or
\n(4) the intent to commit a dangerous felony (which leads to culpability under the felony-murder rule<\/a>).\u00a0<\/strong><\/span><\/p>\n

\u2014 aka premeditated malice<\/strong><\/em><\/span>; preconceived <\/strong><\/em>malice<\/strong><\/em><\/span>; malice prepense<\/strong><\/em><\/span>; malitia praecogitata<\/strong><\/em><\/span>. [1]<\/span><\/p>\n

1. An intent to kill or injure, or the deliberate commission of a dangerous or deadly act in disregard of the lives or safety of others.\u00a0 The word “aforethought” does not refer to the intent to take life, but to the malice.<\/strong> [2]<\/span><\/p>\n

Essentially, as an element of murder, the same as malice<\/a>, a wicked and corrupt disregard of the life and safety of another. 26 Am J1st Homi \u00a7 40<\/span>.<\/strong><\/span>
