1. Murder that is not aggravated<\/a> by any of the circumstances of first-degree <\/a><\/strong>murder.<\/strong> \u2014 aka murder of the second degree<\/strong><\/em><\/span>; murder two<\/strong><\/em><\/span>. [1]<\/span><\/p>\n

1. The killing of a person by intent but without premeditation or deliberation, or, as otherwise stated, without malice aforethought<\/a> or express malice<\/a>. 26 Am J1st Homi \u00a7 38<\/span>.\u00a0 <\/strong><\/span><\/p>\n

Roughly stated, any offense of murder not in the first degree<\/a>.\u00a0 Murder without express malice<\/a> or a state of facts justifying or excusing the killing<\/a> or reducing the offense to manslaughter<\/a>.\u00a0 Often defined by statute as the killing of a person perpetrated by any act imminently dangerous to others and evidencing a depraved mind regardless of human life, although without any premeditated design to effect the death of any person. 26 Am J1st Homi \u00a743<\/span>.<\/strong> [2]<\/span><\/p>\n

Types of Second Degree Murder:<\/span><\/strong><\/p>\n

depraved-heart murder<\/span><\/a> – a murder resulting from an act so reckless and careless of the safety of others, it demonstrates the perpetrator\u2019s complete lack of regard for human life. <\/span><\/strong>\u2014 aka depraved indifference murder<\/em><\/strong><\/span>; unintentional murder<\/em><\/strong><\/span>; extreme indifference murder<\/em><\/strong><\/span>; depraved-mind murder<\/em><\/strong><\/span>.<\/span><\/span><\/p>\n
