R. Crim. P. 7(a)<\/a>.<\/span><\/strong><span style=\"font-size: 14pt;\"> [1]<\/span> <\/span><\/p>\n<p><span style=\"font-size: 14pt; color: #000000;\"><strong>1. A crime to be prosecuted under an <a href=\"https:\/\/reunitethestates.org\/?page_id=9352\" target=\"_blank\" rel=\"noopener\">indictment<\/a>; in some jurisdictions, any <a href=\"https:\/\/reunitethestates.org\/?page_id=13171\" target=\"_blank\" rel=\"noopener\">felony<\/a>. In some <a href=\"https:\/\/reunitethestates.org\/?page_id=5206\" target=\"_blank\" rel=\"noopener\">jurisdictions<\/a>, any <a href=\"https:\/\/reunitethestates.org\/?page_id=13171\" target=\"_blank\" rel=\"noopener\">felony<\/a> and any misdemeanor of a certain class, particularly a misdemeanor of a serious nature. <span style=\"color: #800000;\"><em>State v Berlin<\/em>, 42 M0 572, 576<\/span>. <\/strong><\/span><\/p>\n<p><span style=\"font-size: 14pt; color: #000000;\"><strong>2. A crime prosecute by <a href=\"https:\/\/reunitethestates.org\/?page_id=9352\" target=\"_blank\" rel=\"noopener\">indictment<\/a> rather than by <a href=\"https:\/\/reunitethestates.org\/?page_id=12978\" target=\"_blank\" rel=\"noopener\">information<\/a>.\u00a0 Generally, this means a felony rather than a misdemeanor.<\/strong> [3]<\/span><\/p>\n<p><span style=\"font-size: 14pt; color: #000000;\">\u00a0<strong>\u00a0\u00a0\u00a0 Excerpt from Howard League for Penal Reform&#8217;s <a href=\"https:\/\/howardleague.org\/news\/courtofappealrulingonlegalaid\/\" target=\"_blank\" rel=\"noopener\"><em>Counsel for the Defense:<\/em> <em>An Enquiry into the Question of Legal Aid for Poor Prisoners<\/em><\/a> (1926):<\/strong><\/span><\/p>\n<p><span style=\"font-size: 14pt; color: #000000;\"><strong>\u00a0\u00a0\u00a0\u00a0 &#8220;<span style=\"color: #800000;\">[I]t is impossible to take the distinction between indictable and non-indictable offenses as corresponding with any great accuracy to our actual sense of their importance to the community.\u00a0 Thus we find amongst the list of indictable offenses many that are obsolete or comparatively venial (though no doubt\u00a0 blameworthy!) \u2014 such as play, corruptly taking a reward for restoring a stolen dog, destroying hop-binds, Jesuits and monks coming into the realm, killing hares and rabbits by night in a warren, or &#8216;depraving the Book of Common Prayer.&#8217;\u00a0 On the other hand amongst non-indictable offenses are classed many acts of the utmost importance: Assaulting constables in the execution of their duty, <a href=\"https:\/\/reunitethestates.org\/?page_id=12839\" target=\"_blank\" rel=\"noopener\">aggravated<\/a> and common assaults, brothel-keeping, and cruelty to animals.<\/span>&#8220;<\/strong> [4]<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-size: 18pt; color: #000000;\"><strong><span style=\"color: #ff00ff;\">indictable nuisance<\/span>:<\/strong><\/span><\/p>\n<p><span style=\"font-size: 14pt; color: #000000;\"><strong>1.
