color: #000000;\">\u00a0\u00a0\u00a0\u00a0 The government generally brings criminal charges in one of two ways: by a &#8220;bill of information&#8221; secured by a <a href=\"https:\/\/reunitethestates.org\/?page_id=13587\" target=\"_blank\" rel=\"noopener\">preliminary hearing<\/a>, <em><span style=\"text-decoration: underline;\">or<\/span><\/em> via grand jury indictment.<\/span><\/strong><\/p>\n<p><strong><span style=\"font-size: 14pt; color: #000000;\"><span style=\"font-size: 18pt;\">charging instrument<\/span> &#8211; any of three formal legal documents by which a person can be officially charged with a crime: an indictment, information, or presentment.<\/span><\/strong><\/p>\n<p><strong><span style=\"color: #000000; font-size: 14pt;\"><a href=\"https:\/\/reunitethestates.org\/?page_id=13738\" target=\"_blank\" rel=\"noopener\"><span style=\"font-size: 18pt;\">presentment<\/span><\/a> &#8211; a written accusation returned by a grand jury on its own motion, without a prosecutor\u2019s previous indictment request, which may be used by the prosecutor as the basis for a true bill or indictment.<\/span><\/strong><\/p>\n<p><strong><span style=\"font-size: 14pt; color: #000000;\">\u00a0\u00a0\u00a0\u00a0 In the federal system, cases must be brought by indictment.\u00a0 States, however, are free to use either process.\u00a0 Both preliminary hearings and grand juries are used to establish the existence of probable cause.\u00a0 If there is no finding of probable cause, a defendant will not be forced to stand trial.<\/span><\/strong><\/p>\n<p><span style=\"font-size: 14pt; color: #000000;\"><strong>\u00a0\u00a0\u00a0\u00a0 A <a href=\"https:\/\/reunitethestates.org\/?page_id=13587\" target=\"_blank\" rel=\"noopener\">preliminary hearing<\/a> (also known as a preliminary examination) is an adversarial proceeding in which counsel questions witnesses and both parties makes arguments.\u00a0 The judge then makes the ultimate finding of probable cause.\u00a0<\/strong><\/span><\/p>\n<p><span style=\"font-size: 14pt;\"><strong><span style=\"font-size: 18pt;\"><a href=\"https:\/\/reunitethestates.org\/?page_id=13699\" target=\"_blank\" rel=\"noopener\">probable cause<\/a><\/span> <span style=\"color: #000000;\">\u2013 a reasonable amount of suspicions, supported by circumstances sufficiently strong to justify a prudent and cautious person\u2019s belief that certain facts are probably true.<\/span><\/strong><\/span><\/p>\n<p><span style=\"font-size: 14pt;\"><strong><a href=\"https:\/\/reunitethestates.org\/?page_id=13699\" target=\"_blank\" rel=\"noopener\"><span style=\"font-size: 18pt;\">probable cause<\/span><\/a> <span style=\"color: #000000;\">\u2013 a reasonable amount of suspicions, supported by circumstances sufficiently strong to justify a prudent and cautious person\u2019s belief that certain facts are probably true.<\/span><\/strong><\/span><\/p>\n<p><span style=\"color: #000000;\"><strong><span style=\"font-size: 14pt;\"><a href=\"https:\/\/reunitethestates.org\/?page_id=13587\" target=\"_blank\" rel=\"noopener\"><span style=\"font-size: 18pt;\">preliminary hearing<\/span><\/a> &#8211; any number of &#8220;Probable Cause Hearings&#8221; to determine if there&#8217;s sufficient evidence to hold trial, or if any evidence ought be suppressed due to Fourth Amendment violation. <\/span><\/strong><span style=\"font-size: 14pt;\">\u2014 aka <\/span><span style=\"color: #800000;\"><strong><span style=\"font-size: 14pt;\"><em>preliminary examination<\/em><\/span><\/strong><\/span><span style=\"font-size: 14pt;\">;<\/span><span style=\"color: #800000;\"><strong><span style=\"font-size: 14pt;\"> <em>probable-cause hearing<\/em><\/span><\/strong><\/span><span style=\"font-size: 14pt;\">;<\/span><strong><span style=\"font-size: 14pt;\"><span style=\"color: #800000;\"> <em>bindover hearing<\/em><\/span>; <span style=\"color: #800000;\"><em>examining trial<\/em><\/span><\/span><\/strong><span style=\"font-size: 14pt;\">;<\/span><strong><span style=\"font-size: 14pt;\"> <em><span style=\"color: #800000;\">felony hearing<\/span>.<\/em><\/span><\/strong><\/span><\/p>\n<ul>\n<li><span style=\"font-size: 14pt;\"><strong><a href=\"https:\/\/reunitethestates.org\/?page_id=13711\" target=\"_blank\" rel=\"noopener\"><span style=\"font-size: 18pt;\">bailable offense<\/span><\/a> <span style=\"color: #000000;\">&#8211; an instrument containing a criminal charge, presented to a grand jury by a prosecutor, used by the jury to determine if there&#8217;s enough evidence to formally charge the accused with a crime.\u00a0 After it is found and all the blanks are filled in, it is called an \u201c<\/span><a href=\"https:\/\/reunitethestates.org\/?page_id=9352\" target=\"_blank\" rel=\"noopener\">indictment<\/a><span style=\"color: #000000;\">.\u201d<\/span><br \/>\n<\/strong><\/span><\/li>\n<li><span style=\"font-size: 14pt;\"><strong><span style=\"font-size: 18pt;\"><a href=\"https:\/\/reunitethestates.org\/?page_id=9352\" target=\"_blank\" rel=\"noopener\">indictment<\/a><\/span> <span style=\"color: #000000;\">&#8211; by writing &#8220;true bill&#8221; on the bill, the determination that a criminal charge should go before a <a href=\"https:\/\/reunitethestates.org\/?page_id=10243\" target=\"_blank\" rel=\"noopener\">petty jury<\/a> for trial is officially indorsed by the grand jury. <\/span><\/strong><span style=\"color: #000000;\">\u2014 aka<span style=\"color: #800000;\"><strong> <em>billa vera<\/em><\/strong><\/span><em>.<\/em><\/span><\/span><\/li>\n<li><span style=\"font-size: 14pt;\"><strong><span style=\"font-size: 18pt;\"><a href=\"https:\/\/reunitethestates.org\/?page_id=13724\" target=\"_blank\" rel=\"noopener\">no bill<\/a> <\/span><span style=\"color: #000000;\">&#8211;
