1. A judicial hearing, session, or lawsuit in which the purpose is to decide or delineate private rights and remedies, as in a dispute between litigants in a matter relating to torts<\/a>, contracts<\/a>, property<\/a>, or family law.<\/strong> [1]<\/span><\/p>\n

Stages of a Civil Proceeding:<\/strong><\/span><\/p>\n

a.) Pretrial<\/a>:<\/strong><\/span><\/div>\n

  1. Process<\/a> – the plaintiff files a complaint and summons.<\/strong><\/span><\/li>\n
  2. Case Preparation<\/a> – discovery of evidence; witness depositions and pretrial motions.<\/strong><\/span><\/li>\n
  3. Settling Difference<\/a> – parties urged to reach settlement to avoid the need for trial.<\/span><\/strong><\/span><\/li>\n<\/ol>\n
    b.) Trial Process<\/a> –<\/span> evidence is presented, and witnesses testify.<\/span><\/strong><\/span><\/div>\n
    c.) Closing<\/a> –<\/span> final findings of law and fact are concluded; judgment.<\/span><\/strong><\/span><\/div>\n

    What is a Civil Action?<\/span><\/a><\/strong><\/span><\/p>\n

    \u00a0 \u00a0\u00a0 Although an “action<\/a>” can refer to <\/strong>a civil<\/a> or criminal judicial proceeding<\/a>, today it generally refers to a civil action.\u00a0 Although historically there were 11 common-law forms of action<\/a>, in today’s U.S. courts they have been simplified into <\/strong>“one form of action\u2014 the civil action<\/a>.”\u00a0<\/strong>[1]<\/span><\/p>\n
