Homicide in which there is no intention to kill or do grievous bodily harm, but that is committed with criminal negligence or <\/strong>during the commission of a crime not included within the felony-murder rule<\/a>.<\/strong> \u2014 aka involuntary manslaughter<\/strong><\/em><\/span>; negligent manslaughter<\/strong><\/em><\/span>; manslaughter in the second degree<\/strong><\/em><\/span>.\u00a0 Cf. The unintentional killing of another occasioned by a person engaged at the time in doing some unlawful act not amounting to a felony and not likely or naturally tending to endanger life, or engaged in the doing of a lawful act in an unlawful manner. 26 Am J1st Homi \u00a7 18<\/span>.<\/span><\/strong><\/p>\n

The killing of another without malice<\/a> and unintentionally, <\/span><\/strong><\/p>\n

(1) in doing some unlawful act not amounting to a felony or naturally ending to cause death or great bodily harm, or<\/span><\/strong>
\n(2) in negligently doing some act lawful in itself, or <\/span><\/strong>

\u00a0\u00a0\u00a0\u00a0 \u201cThe only differences between the legal use and the everyday use of \u2018voluntary,\u2019 \u2018not voluntary,\u2018 and \u2018involuntary\u2019 seem to be <\/span><\/strong><\/span><\/p>\n

(a) a more frequent use of \u2018involuntary\u2019 as a synonym of \u2018not voluntary\u2019 and
\n(b) a technical use of \u2018involuntary\u2019 in the crime of \u2018involuntary manslaughter,\u2019 where it seems to have the meaning of \u2018unintentional.\u2019 <\/strong><\/span><\/p>\n

\u00a0\u00a0\u00a0\u00a0 Thus, as contrasted with \u2018voluntary manslaughter,\u2019 there is no suggestion that death, as contrasted with harm, was intended or foreseen.\u00a0 Though it is often confined to cases of assault and battery where death results, for example either from the withholding of food or from excessive chastisement of a child, some jurists say that it can be due to any unlawful and dangerous action causing death.<\/span>\u201d<\/strong> [5]<\/span><\/p>\n
