Hart&#8217;s \u201cProlegomenon to the Principles of Punishment,\u201d in<a style=\"color: #000000;\" href=\"https:\/\/www.amazon.com\/Punishment-Responsibility-Essays-Philosophy-Law\/dp\/0199534780\" target=\"_blank\" rel=\"noopener\"><em> Punishment and Responsibility<\/em><\/a> (1968):<\/strong><\/span><\/p>\n<p><span style=\"font-size: 14pt; color: #000000;\"><strong>\u00a0\u00a0\u00a0\u00a0 \u201c<span style=\"color: #800000;\">English lawyers once distinguished between \u2018excusable\u2019 homicide (e.g. accidental non-negligent killing) and \u2018justifiable\u2019 homicide (e.g. killing in self-defence or in the arrest of a felon) and different legal consequences once attached to these two forms of homicide.\u00a0 To the modern lawyer this distinction has no longer any legal importance: he would simply consider both kinds of homicide to be cases where some element, negative or positive, required in the full definition of criminal homicide (murder or manslaughter) was lacking. But the distinction between these two different ways in which actions may fail to constitute a criminal offence is still of great moral importance.\u00a0 Killing in self-defence is an exception to a general rule making killing punishable; it is admitted because the policy or aims which in general justify the punishment of killing (e.g. protection of human life) do not include cases such as this. App. 4th 1033,1044 (2007):<\/strong><\/span><\/p>\n<p><span style=\"font-size: 14pt; color: #000000;\"><strong>\u00a0\u00a0\u00a0\u00a0 \u201c<span style=\"color: #800000;\">California belongs to the\u00a0<span class=\"text_exposed_show\">majority of jurisdictions with a \u2018[n]o [r]etreat [r]ule,\u2019 under which the victim of an assault is under no obligation to \u2018retreat to the wall\u2019 before exercising the right of self-defense, but is entitled to \u2018stand <\/span>his ground.\u201d<\/span>\u2019<\/strong> [6]<\/span><\/p>\n<p><span style=\"color: #000000; font-size: 14pt;\"><strong><span style=\"color: #ff00ff; font-size: 18pt;\">stand-your-ground law<\/span> &#8211;<\/strong> (2006) <strong>A statute providing that a potential victim of a crime need not retreat before responding with force in self-defense to a threat, even if flight is possible.\u00a0 *\u00a0 The stand-your-ground law immunizes the actor against civil suits and criminal charges when force was used justifiably in self-defense.<\/strong><\/span><\/p>\n<p><span style=\"color: #000000; font-size: 14pt;\"><strong><span style=\"color: #ff00ff; font-size: 18pt;\">castle doctrine<\/span> &#8211;<\/strong> (1892) <em>Criminal law<\/em>.<strong> An exception to the retreat rule allowing the use fo deadly force by a person who is protecting his or her home and its inhabitants from attack, especially from a trespasser who intends to commit a felony or inflict serious bodily harm.<\/strong> \u2014 aka<span style=\"color: #800000;\"><em><strong> dwelling defense<\/strong><\/em><\/span>; <span style=\"color: #800000;\"><em><strong>defense of habitation<\/strong><\/em><\/span>.
