\u00a0 \u00a0 \u201c\u2018Proceeding\u2019 is a word much used to express the business done in courts.\u00a0 A proceeding in court is an act done by the authority or direction of the court, express or implied.\u00a0 It is more comprehensive than the word \u2018action,\u2019 but it may include in its general sense all the steps taken or measures adopted in the prosecution or defense of an action, including the<\/span> pleadings<\/a> and judgment.\u00a0 As applied to actions, the term \u2018proceeding’ may include-<\/span><\/strong><\/span><\/div>\n

\n(1) the institution of the action;
\n<\/strong>(2) the appearance of the defendant;
\n<\/strong><\/span>(3) all ancillary or provisional steps, such as arrest, attachment of property, garnishment,<\/span> injunction<\/a>, writ of ne exeat<\/em><\/a>;<\/span>
\n (4) the<\/span> pleadings<\/a>;<\/span>
\n<\/strong>(5) the taking of testimony before trial;
\n<\/strong><\/span>(6) all<\/span> motions<\/a> made in the action;<\/span>
\n (7) the trial;<\/span>
\n (8) the judgment;<\/span>
\n (9) the execution;<\/span>
\n (10) proceedings supplementary to execution, in code practice;<\/span>
\n (11 ) the taking of the appeal or<\/span> writ of error<\/a>;<\/span>
\n (12) the<\/span> remittitur<\/a>, or sending back of the record to the lower court from the appellate or reviewing court;<\/span>
\n (13) the enforcement of the judgment, or a new trial, as may be directed by the court of last resort.<\/span>\u201d <\/strong>[4]<\/span><\/p>\n
