Byrd<\/em> affidavit<\/span>:<\/span>
\n<\/strong>(1984)<\/span><\/p>\n

1.<\/strong> Criminal procedure<\/em>. A defendant\u2019s affidavit<\/a> in support of a motion to sever<\/a> on the grounds that a codefendant will give exculpatory testimony for <\/strong>the defendant.\u00a0 *\u00a0 The affidavit must show <\/strong><\/span><\/p>\n

(1) a bona fide need for the testimony,
\n(2) the substance of the testimony,
\n(3) its exculpatory nature, and
\n(4) that the codefendant would actually testify if the cases were severed.<\/strong><\/span><\/p>\n
