an affidavit that sets forth facts and circumstances supporting the existence of probable cause, requesting the judge to issue a<\/span> <a href=\"https:\/\/reunitethestates.org\/?page_id=14100\" target=\"_blank\" rel=\"noopener\">search warrant<\/a><span style=\"color: #000000;\">.<\/span><\/span><\/strong><\/p>\n<p><span style=\"font-size: 14pt;\"><span style=\"font-size: 18pt;\"><strong><span style=\"color: #ff00ff;\">self-proving affidavit<\/span>:<\/strong><\/span> (1964) <strong>An affidavit attached to a will and signed by the testator and witnesses certifying that the statutory requirements of due execution of the will have been complied with.\u00a0 *\u00a0 The affidavit, which <\/strong><\/span><strong><span style=\"font-size: 14pt;\">recites the facts of the Will\u2019s proper execution, permits the will to be probated without the necessity of having the witnesses appear and prove due execution by their testimony.<\/span><\/strong><\/p>\n<p><span style=\"font-size: 14pt;\"><strong><span style=\"font-size: 18pt;\"><span style=\"color: #ff00ff;\">sham affidavit<\/span>:<\/span><\/strong> (1942)<strong> An affidavit that contradicts clear testimony given by the same witness, usually used in an attempt to create an issue of fact in response to a <a href=\"https:\/\/reunitethestates.org\/?page_id=6349\" target=\"_blank\" rel=\"noopener\">motion for summary judgment<\/a>.\u00a0 *\u00a0 All the <a href=\"https:\/\/reunitethestates.org\/?page_id=2524\" target=\"_blank\" rel=\"noopener\">federal circuit courts<\/a> have adopted some form of the sham-affidavit rule, which precludes a litigant from creating an issue of material fact by contradicting earlier sworn testimony in the absence of persuasive reasons why the new testimony is more accurate than the earlier testimony.<\/strong><\/span><\/p>\n<p><span style=\"font-size: 14pt;\"><span style=\"font-size: 18pt;\"><strong><span style=\"color: #ff00ff;\">supplemental affidavit<\/span>:<\/strong><\/span> (18c) <strong>An affidavit made in addition to a previous one, usually to supply additional facts.<\/strong> <\/span><\/p>\n<p><span style=\"font-size: 14pt;\"><strong><span style=\"font-size: 18pt;\"><span style=\"color: #ff00ff;\">affidavit of engagement<\/span>:<\/span><\/strong> (1916) <strong>A lawyer\u2019s sworn statement to a court requesting an adjournment because of another court appearance scheduled for the same time.<\/strong> \u2014 aka <span style=\"color: #800000;\"><em><strong>affidavit of prior engagement<\/strong><\/em><\/span>.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\"><span style=\"font-size: 18pt;\"><strong><span style=\"color: #ff00ff;\">affidavit of errors<\/span>:<\/strong><\/span> (1943) <strong>An appellant\u2019s written statement enumerating the grounds for appeal, usually from a court not of record (that is, in which proceedings have not been transcribed by a court reporter).<\/strong><\/span><\/p>\n<p><span style=\"font-size: 14pt;\"><strong><span style=\"font-size: 18pt;\"><span style=\"color: #ff00ff;\">affidavit of merit<\/span>:<\/span><\/strong> See certificate of merit (2) under CERTIFICATE.<\/span><\/p>\n<p><span style=\"font-size: 14pt;\"><strong><span style=\"font-size: 18pt;\"><span style=\"color: #ff00ff;\">affidavit of verification<\/span>:<\/span><\/strong> See VERIFICATION (I).<\/span><\/p>\n<p style=\"text-align: center;\"><strong><span style=\"font-size: 14pt;
