1. One to whom property rights or powers are transferred by another.\u00a0 *\u00a0 Use of the term is so widespread that it is difficult to ascribe positive meaning to it with any specificity.\u00a0 Courts recognize the protean nature of the term and are therefore often forced to look to the intent of the assignor and assignee in making the assignment \u2014 rather than to the formality of the use of the term assignee \u2014 in defining <\/span><\/strong>rights and responsibilities.\u00a0<\/strong>\u2014 aka assign<\/strong><\/em><\/span>. 1. A person to whom a right is assigned, that is, the one to whom an assignment is made.\u00a0 6 Am J2d Assign \u00a7\u00a0 2<\/span>.<\/span><\/strong><\/p>\n

A person who becomes invested with the right of another person through some voluntary act of that other person.\u00a0 United States v Colorado Anthracite Coal Co.,<\/em> 225 US 219, 56 L Ed 1063, 32 S Ct 617<\/span>. <\/span><\/strong><\/p>\n

More broadly defined as including all those who take either immediately or remotely from or under the assignor, whether by conveyance, devise, descent, or act of law. Hoffeld <\/em><\/span><\/span>v United States<\/em>, 186 US 273, 46 L Ed 1160, 22 S Ct 927<\/span>.<\/span><\/strong><\/p>\n

Where there are no qualifying words, the term in its usual meaning refers to an assignee in fact and does not comprehend an assignee by mere operation of law, such as a surviving partner. Burlington Nat. Bank v Beard<\/em>, 55 Kan 773, 42 P 320<\/span>. <\/span><\/span><\/strong><\/p>\n

The words \u201cassignee of such deceased person\u201d in a statute disqualifying an adverse party as a witness is limited to an assignee in fact, and does not include an assignee by mere operation of law. So construed, the word does not include a legatee, a purchaser at an execution sale, or a trustee appointed on the <\/span>death of a testamentary trustee. 58 Am, J1st Witn \u00a7 335<\/span>.<\/strong> [2]

absolute assignee<\/span>:<\/strong> <\/span>(1809) Someone who is assigned an unqualified interest in property in a transfer of some or all of the incidents of ownership.<\/strong><\/span><\/p>\n

assignee ad interim<\/span>:<\/span> An assignee appointed between <\/span><\/strong>the time of bankruptcy and the appointment of a regular assignee.<\/strong>
\n<\/span><\/p>\n

assignee for value<\/span>:<\/strong><\/span> (18c) An assignee who has paid for or otherwise given consideration for the assignment.<\/strong><\/span><\/p>\n

co-assignee<\/span>:<\/strong><\/span> (1856) Someone who, along with one or more others, is an assignee of the same subject matter.<\/strong><\/span><\/p>\n

collateral assignee<\/span>:<\/strong><\/span> (1889) A lender who is assigned an <\/strong><\/span>interest in property (usu. real property) as security for a loan.<\/span><\/strong><\/p>\n

gratuitous assignee<\/span>:<\/strong><\/span> (1928) An assignee under an assignment not given for value.<\/strong><\/span><\/p>\n

subassignee<\/span>:<\/strong><\/span> (1830) A person to whom a right is assigned by one who is a previous assignee of the right.<\/strong><\/span><\/p>\n
