Without a principal there can be no surety.<\/span> <span style=\"color: #800000;\"><em>First Nat. Bank v Boxley<\/em>, 129 Okla 159, 264 P 184, 64 <\/span><\/span><span style=\"font-size: 14pt;\"><span style=\"color: #800000;\">ALR 588<\/span><span style=\"color: #000000;\">. <\/span><\/span><\/strong><\/p>\n<p><span style=\"color: #000000;\"><strong><span style=\"font-size: 14pt;\">The vital difference between the contract of a <\/span><span style=\"font-size: 14pt;\">surety and that of a guarantor is that a surety is charged as an original promisor, while the engagement of the guarantor is a collateral undertaking.\u00a0 A surety is a party to the principal obligation, undertaking together with the principal debtor that it shall be performed, while the guarantor is not a <\/span><\/strong><\/span><span style=\"font-size: 14pt;\"><strong><span style=\"color: #000000;\">party to the principal obligation.<\/span><span style=\"color: #800000;\"> 24 Am J1st Guar \u00a7 11<\/span><span style=\"color: #000000;\">.<\/span><\/strong><span style=\"color: #000000;\"> [2]<\/span><\/span><\/p>\n<p><span style=\"font-size: 14pt; color: #000000;\"><strong>1.
