Even if the injured party sustains no pecuniary loss or is unable to show such loss with sufficient certainty, he has at least a claim for nominal damages.\u00a0 If a court chooses to ignore a trifling departure, there is no breach and no claim arises.<\/span>\u201d<\/strong> [4]<\/span><\/p>\n<p><span style=\"font-size: 14pt;\"><span style=\"font-size: 18pt;\"><strong><span style=\"color: #ff00ff;\">active breach of contract<\/span><span style=\"color: #000000;\">:<\/span><\/strong><\/span><span style=\"color: #000000;\"> (1840) <em>Civil law<\/em>. <\/span><strong><span style=\"color: #000000;\">The negligent performance of a contractual obligation, to the point of acting outside the contract\u2019s terms.\u00a0 *\u00a0 Under Louisiana law before 1984, active breach of contract was contrasted with passive breach of contract, which was a failure to perform the obligations created by the contract.\u00a0 Unlike a passive breach, an active breach of contract could give rise to a claim in<\/span> <a href=\"https:\/\/reunitethestates.org\/?page_id=8143\" target=\"_blank\" rel=\"noopener\">contract<\/a> <span style=\"color: #000000;\">and in<\/span> <a href=\"https:\/\/reunitethestates.org\/?page_id=7037\" target=\"_blank\" rel=\"noopener\">tort<\/a><span style=\"color: #000000;\">.\u00a0 The distinction was abolished in 1984.<\/span><\/strong><\/span><\/p>\n<p><span style=\"font-size: 14pt;\"><span style=\"font-size: 18pt;\"><strong><a href=\"https:\/\/reunitethestates.org\/?page_id=11535\" target=\"_blank\" rel=\"noopener\">immediate breach<\/a><span style=\"color: #000000;\">:<\/span><\/strong><\/span><span style=\"color: #000000;\"> (1820) <strong>A breach that entitles the nonbreaching party to sue for damages immediately.<\/strong><\/span><\/span><\/p>\n<ul>\n<li><strong><span style=\"font-size: 14pt;\"><a href=\"https:\/\/reunitethestates.org\/?page_id=11538\" target=\"_blank\" rel=\"noopener\"><span style=\"font-size: 18pt;\">anticipatory breach<\/span><\/a> <span style=\"color: #000000;\">&#8211; a breach of contract caused by a party\u2019s unequivocal indication that the party will not perform when performance is due; the nonbreaching party may elect to treat the repudiation as an immediate breach and sue for<\/span> <a href=\"https:\/\/reunitethestates.org\/?page_id=6814\" target=\"_blank\" rel=\"noopener\">damages<\/a><span style=\"color: #000000;\">.<\/span><\/span><\/strong><\/li>\n<\/ul>\n<p><span style=\"font-size: 14pt;\"><span style=\"font-size: 18pt;\"><strong><span style=\"color: #ff00ff;\">continuing breach<\/span><span style=\"color: #000000;\">:<\/span><\/strong><\/span><span style=\"color: #000000;\"> (1817)<strong> A breach of contract that endures for a considerable time or is repeated at short intervals.<\/strong><\/span><\/span><\/p>\n<p><span style=\"font-size: 14pt;\"><span style=\"font-size: 18pt;\"><strong><span style=\"color: #ff00ff;\">efficient breach<\/span><span style=\"color: #000000;\">:<\/span><\/strong><\/span><span style=\"color: #000000;\"> (197 7) <\/span><strong><span style=\"color: #000000;\">An intentional breach of contract and payment of damages by a party who would incur greater economic loss by performing under the<\/span> <a href=\"https:\/\/reunitethestates.org\/?page_id=8143\" target=\"_blank\" rel=\"noopener\">contract<\/a><span style=\"color: #000000;\">.\u00a0<\/span><\/strong><span style=\"color: #000000;\"> See EFFICIENT-BREACH THEORY.<\/span><\/span><\/p>\n<p><strong><span style=\"font-size: 14pt;\"><span style=\"color: #000000;\"><a href=\"https:\/\/reunitethestates.org\/?page_id=11542\" target=\"_blank\" rel=\"noopener\"><span style=\"font-size: 18pt;\">total breach<\/span><\/a> &#8211; a breach of contract which goes to the whole consideration, for which the remedial rights provided by law are substituted for all the existing contractual rights, or can be so substituted by the injured party, who becomes entitled to sue for<\/span> <a href=\"https:\/\/reunitethestates.org\/?page_id=6814\" target=\"_blank\" rel=\"noopener\">damages<\/a>.<\/span><\/strong><\/p>\n<ul>\n<li><strong><span style=\"font-size: 14pt;\"><a href=\"https:\/\/reunitethestates.org\/?page_id=11544\" target=\"_blank\" rel=\"noopener\"><span style=\"font-size: 18pt;\">material breach<\/span><\/a> <span style=\"color: #000000;\">&#8211; a breach of contract sufficiently substantial to give the injured party the right to rescind the contract or to maintain an action for damages, or both.<\/span><\/span><\/strong><\/li>\n<\/ul>\n<p><span style=\"font-size: 14pt;\"><span style=\"font-size: 18pt;\"><strong><span style=\"color: #ff00ff;\">partial breach<\/span><span style=\"color: #000000;\">:<\/span><\/strong><\/span><span style=\"color: #000000;\"> (18c) <strong>A breach of contract that is less significant than a material breach and that gives the <\/strong><\/span><\/span><span style=\"color: #000000;\"><strong><span style=\"font-size: 14pt;\">aggrieved party a right to damages, but does not excuse that party from performance;
