1.<\/strong> Roman civil law<\/em>. An action to establish and enforce title to property independently of the right to possession. <\/strong><\/span><\/p>\n

2.<\/strong> Civil law<\/em>.\u00a0<\/strong>An action for the recognition of ownership or other real right in immovable (or sometimes movable<\/a>) property.\u00a0 *\u00a0 In civil-law systems, the petitory action (revendication) is a much broader and more effective remedy than the reivindicatio, the Roman prototype.\u00a0 This action is based on, and tends to protect, real rights, that is, ownership<\/a> and its dismemberments.\u00a0 It is therefore a real action, distinguishable from personal actions<\/a> based on (and tending to protect) personal rights.\u00a0 Generally, the petitory action is available for the protection of the ownership of both movables<\/a> and immovables.\u00a0 In Louisiana, however, the petitory action is for the recognition of ownership or other real right in immovable property. brought by a person who is not in possession of it. La. Code Civ. Proc. art. 3651.\u00a0 An action for the recognition of such a right in movable property<\/a> is an innominate real action, known as a revendicatory action.<\/strong> \u2014 aka petitory suit<\/strong><\/em><\/span>; petitorium<\/strong><\/em><\/span>; revendication<\/strong><\/em><\/span>.<\/span><\/p>\n
