The giving of something with the intention, express or implied, that <\/span>it is to extinguish some existing legal or moral obligation.\u00a0 Satisfaction differs <\/span>from performance because it is always something given as a substitute for or <\/span>equivalent of something else, while performance is the identical thing promised to <\/span><\/strong>be done.<\/strong> \u2014 aka satisfaction of debt<\/strong><\/em><\/span>. <\/span><\/p>\n

\u00a0\u00a0\u00a0\u00a0 \u201cSatisfaction closely resembles performance. Both<\/span><\/span><\/strong>
\ndepend upon presumed intention to carry out an obligation, <\/span>but in satisfaction the thing done is something different from <\/span>the thing agreed to be done, whereas in performance the <\/span>identical act which the party contracted to do is considered to <\/span>have been done.\u00a0 The cases on satisfaction are usually grouped <\/span>under four heads, namely, <\/span><\/strong><\/span><\/p>\n

1.) satisfaction of debts by legacies<\/span><\/strong><\/span>
\n2.) satisfaction of legacies by legacies
\n3.) satisfaction (or <\/span>ademption) of legacies by portions 4.) satisfaction of portion-<\/span><\/strong><\/span>
\ndebts by legacies, or by portions.<\/span><\/strong><\/span><\/p>\n

Strictly, however, only the first and last of these heads are really cases of satisfaction; for <\/span>satisfaction presupposes an obligation, which, of course, does <\/span><\/strong><\/span>not exist in the case of a legacy in the will of a living person.<\/span>\u201d<\/strong> [4]<\/span><\/p>\n
